These amendments were introduced to keep pace with social and security developments and to strengthen the criminal justice system by imposing stricter penalties for sexual offenses\u2014particularly those committed against minors\u2014criminalizing forms of incitement and exploitation and developing mechanisms for assessing criminal dangerousness.<\/p><p>These amendments are among the most stringent and explicit in the history of Emirati criminal legislation, reflecting the legislator\u2019s firm intent to achieve both general and specific deterrence, protect society, and ensure that perpetrators of serious crimes do not evade effective punishment.<\/p><p>\u00a0<\/p><h2><strong>First: Toughening Penalties for Sexual Crimes Committed Against Minors<\/strong><\/h2><p>The Decree-Law firmly established the principle of enhanced criminal protection for minors by aggravating the penalties prescribed for sexual offenses whenever the victim is under eighteen years of age.<\/p><p>The amendments stipulate that:<\/p><ul><li>Any person who has sexual intercourse with a female or engages in sexual contact with a person under the age of 18 shall be punished by imprisonment for a period of not less than ten years.<\/li><li>A fine of not less than AED 100,000 shall be imposed in addition to the custodial sentence, even in cases where consent is alleged.<\/li><\/ul><p>The Emirati legislator unequivocally affirmed that consent shall have no legal effect if the victim is under the age of 16. This provision aligns with international standards for the protection of children and effectively precludes any attempt to justify the offense based on alleged consent.<\/p><p>The law also provides that the provisions of the Juvenile Delinquents and Juveniles at Risk Law shall apply to people under 18 years of age, thereby ensuring a balance between protection, care, and rehabilitation, without prejudice to the strict punishment imposed on adult offenders.<\/p><p>\u00a0<\/p><h2><strong>Second: Toughening Penalties for Crimes of Incitement and Luring into Debauchery or Prostitution<\/strong><\/h2><p>As part of the legislator\u2019s approach to preventing crime before its occurrence, the new amendments intensified penalties for offenses involving:<\/p><ul><li>Incitement,<\/li><li>Luring,<\/li><li>Seduction, or<\/li><li>Assisting in debauchery or prostitution.<\/li><\/ul><p>Accordingly, the law provides for:<\/p><ul><li>Imprisonment for a period of not less than two years and a fine for anyone who commits any of these acts.<\/li><li>A more severe penalty of imprisonment and a fine if the victim is a minor under the age of 18.<\/li><\/ul><p>This provision demonstrates a clear legislative intent to protect minors from exploitation networks and moral corruption, and to confront crimes committed through indirect means that are no less dangerous than the principal offense itself.<\/p><p>\u00a0<\/p><h2><strong>Third: Mechanisms for Assessing Convicted Persons in Serious Crimes<\/strong><\/h2><p>One of the most notable legislative developments introduced by the Decree-Law is the enhancement of judicial powers to assess the criminal dangerousness of persons convicted of certain offenses classified as serious crimes.<\/p><p>The law permits:<\/p><ul><li>Subjecting the convicted person to medical, psychological, and social examinations during the last six months of the sentence.<\/li><li>Using the results of such assessments as an auxiliary tool in determining whether to grant release or continue enforcement of the sentence.<\/li><\/ul><p>This approach reflects a modern understanding of criminal punishment as a means of both protection and rehabilitation, rather than a rigid punitive measure, while giving due consideration to public safety and the prevention of potential risks to society.<\/p><p>\u00a0<\/p><h2><strong>Fourth: Suspension of the Execution of Custodial Sentences Subject to Conditions<\/strong><\/h2><p>The amendments authorize the court, upon the request of the Public Prosecutor, to suspend the execution of a custodial sentence in certain offenses that do not affect state security, provided that serious reasons exist to warrant confidence in the convicted person\u2019s conduct and reform.<\/p><p>This provision embodies the principle of individualization of punishment and grants the judiciary legal flexibility to consider the circumstances of each case, without undermining the authority of the law or the objectives of deterrence.<\/p><p>\u00a0<\/p><h2><strong>Fifth: Legislative and Criminal Policy Dimensions of the Amendments<\/strong><\/h2><p>These amendments confirm that the criminal policy of the United Arab Emirates is founded on:<\/p><ul><li>Protecting minors and vulnerable groups,<\/li><li>Strengthening deterrence for crimes with serious societal impact,<\/li><li>Achieving a balance between punishment and rehabilitation, and<\/li><li>Modernizing legislation in line with social and legal developments.<\/li><\/ul><p>They also reflect the State\u2019s commitment to relevant international conventions concerning the rights of the child and the identity of sexual crimes and unlawful
